Health & Medical Disclaimer: Fitistic provides tools for personal workout logging, general nutrition tracking, and wellness routines. It does not provide medical advice. Consult a healthcare physician before initiating any demanding exercise or dietary program.

Agreement to Terms

By downloading, installing, registering for, or using the Fitistic mobile application ("App") or related services, you confirm that you have read, understood, and agreed to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not install or use Fitistic.

1. Eligibility

You must be at least 13 years of age to create an account and use Fitistic. By using the App, you warrant and represent that you meet this requirement. If you are between 13 and 18 years of age, you confirm that your parent or legal guardian has reviewed and accepted these Terms on your behalf.

2. User Accounts & Security

To access core features such as cross-session history and AI recommendations, you must establish an account:

  • You agree to provide true, current, and accurate registration information.
  • You are responsible for maintaining the confidentiality of your credentials and account access.
  • You must notify us immediately at support@fitistic.com if you suspect unauthorized access or security breaches of your account.
  • Account credentials may not be shared, rented, or transferred to any third party.

3. Acceptable Use Policy

You agree to use Fitistic solely for lawful personal fitness tracking. You agree that you will not:

  • Decompile, reverse engineer, disassemble, or derive source code from the App or underlying APIs.
  • Use automated systems, scripts, bots, or scrapers to extract information from our services.
  • Interfere with, overburden, or compromise the security, integrity, or network availability of the App.
  • Upload or transmit harmful code, viruses, or malicious payloads.
  • Attempt to bypass authentication locks or access non-public endpoints.

4. Physical Fitness & Medical Disclaimer

Fitistic and its features—including workout routines, demonstration videos, caloric recommendations, and AI Coach suggestions—are provided strictly for general informational and educational purposes.

Not Medical Advice: The App does not offer medical advice, physical therapy diagnoses, or medical treatment plans. You should always obtain clearance from a licensed physician prior to beginning any rigorous physical conditioning, weight training, or caloric restriction program.

Assumption of Risk: Exercise inherently carries risk of physical injury. You assume all voluntary risks associated with performing physical exercises, stretches, or lifts tracked via the App.

5. Intellectual Property Rights

The Fitistic service, including its trademark, software codebase, visual designs, icons, workout catalogs, and proprietary algorithms, is the exclusive intellectual property of Fitistic and its licensors. You are granted a limited, personal, non-exclusive, revocable license to use the App on your Android device in conformity with these Terms.

6. User Logs & Content Ownership

You retain full ownership of the data you enter into Fitistic, including your personal workout weights, reps, nutrition logs, and progress metrics. You grant Fitistic a worldwide, royalty-free license to store, sync, and process this content solely to deliver, improve, and troubleshoot the services for you.

7. Google Play Billing & Subscriptions

Fitistic may offer optional premium features or advanced analytics:

  • All financial transactions, subscriptions, and payment processing are handled securely through Google Play In-App Billing.
  • Subscriptions automatically renew unless cancelled through your Google Play account settings at least 24 hours prior to the conclusion of the active billing cycle.
  • Refund requests are governed by Google Play's standard customer refund guidelines and policies.

8. Limitation of Liability

To the fullest extent authorized under applicable law, Fitistic, its affiliates, developers, directors, and agents shall not be liable for any indirect, punitive, special, incidental, or consequential damages—including personal injury, athletic strain, property damage, loss of data, or interruption of service—resulting from your use or inability to use the App.

9. Account Termination

You may terminate your account at any time via App settings or by sending an email request to our support desk. We reserve the right to suspend or terminate accounts that breach these Terms, engage in fraudulent usage, or compromise app operations.

10. Modifications to Terms

We may revise these Terms occasionally. Continued access or use of Fitistic after any modifications take effect indicates your legal acceptance of the updated terms.
